Conditions of Use

Effective March 1, 2026

These Conditions of Use govern your access to and use of the Market Express Government portal and associated services. Orders placed through this portal are subject to applicable federal acquisition regulations (FAR) and these terms.

Government Contracting Addendum

  • ✓Orders placed through the Government portal may be subject to the Federal Acquisition Regulation (FAR) and agency-specific supplements.
  • ✓Market Express holds CAGE code on file. Contracting officers may request a current W-9 and capability statement at procurement@marketexpres.us.
  • ✓Nothing in these terms limits the rights of the U.S. Government as set forth in applicable FAR clauses.
  • ✓ITAR-controlled and export-restricted items are not available through this portal.

1. Acceptance of Terms

By accessing or using any Market Express service, you agree to be bound by these Conditions of Use and all policies incorporated by reference, including our Privacy Notice, Acceptable Use Policy, and any channel-specific addenda. If you do not agree, do not use the service.

2. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at security@marketexpres.us if you suspect unauthorized access.

3. Eligibility

Market Express services are available only to persons or entities that can form legally binding contracts under applicable law. Accounts are subject to approval. Market Express reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.

4. Products and Pricing

Product listings, descriptions, and prices are subject to change without notice. Market Express does not warrant that product descriptions or prices are accurate, complete, or current. In the event of a pricing error, Market Express reserves the right to cancel orders placed at the incorrect price.

5. Orders and Payment

By submitting an order, you authorize Market Express to charge your selected payment method for the total amount including applicable taxes and shipping. Orders are not binding until confirmed by Market Express. Market Express reserves the right to cancel or limit order quantities.

6. Shipping and Delivery

Estimated delivery dates are not guaranteed. Risk of loss and title for items pass to you upon delivery by the carrier. Market Express is not responsible for delays caused by carriers, customs, or events outside our control.

7. Returns and Refunds

Returns are subject to our Returns Policy available at /returns. Items must be returned in their original condition within the applicable return window. Refunds are processed to the original payment method within 5–10 business days of receipt.

8. Intellectual Property

All content on Market Express, including text, graphics, logos, and software, is the property of Market Express LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

9. Prohibited Conduct

You agree not to: (a) use the service for any unlawful purpose; (b) attempt to gain unauthorized access to any system; (c) transmit harmful code or interfere with the service; (d) scrape or harvest data without written consent; (e) circumvent any security or access control measures.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MARKET EXPRESS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKET EXPRESS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Governing Law and Disputes

These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute arising out of these terms shall be resolved by binding arbitration in Clark County, Nevada, except that either party may seek injunctive relief in any court of competent jurisdiction.

13. Changes to Terms

Market Express reserves the right to modify these Conditions of Use at any time. Changes will be posted with an updated effective date. Continued use of the service after changes are posted constitutes your acceptance of the revised terms.
